We have three solicitors – all at partnership level – who are able to advise employees on their position when their employer has invited them to enter into a settlement agreement.
Although we are based in Taunton, Somerset and in Devon, we offer this service nationwide, assisting employees from all across the country.
Our fees for this service are usually met by the employer, so there is no cost to the employee. When offering a settlement agreement the employer will normally state what contribution they are willing to make to the cost of their employee obtaining the required independent legal advice. However, if your employer has not specified this then we will be happy to contact them to obtain clarification.
The legal process is very straightforward. When you are in the position to go ahead all you need to do is send us a copy of the proposed settlement agreement, together with any key correspondence that you have exchanged with your employer.
We can then arrange to provide you with the legal advice, either meeting you face-to-face if you are local or alternatively over the telephone. We can also provide legal advice on a settlement agreement via video link.
We will offer you guidance on the legal implications of the agreement, concentrating on issues such as confidentiality, compensation payments, unpaid remuneration and the wording of the reference that you will receive.
If you wish to go back to your employer to undertake further negotiations on the terms of the settlement before concluding it, then that can be facilitated.
Once you are happy with the terms and understand your legal position then the agreement can be signed off and we will recover our fees from your employer.
