What is a Lasting Power of Attorney?

A Lasting Power of Attorney, or LPA, is a legal document which allows you to appoint Attorneys who will be able to make decisions on your behalf.

There are two types of Lasting Power of Attorney. 

  • Health and Welfare LPA

A Health and Welfare LPA allows you to name Attorneys who will be able to make decisions about your living arrangements, your healthcare and even your medical treatment. The Attorneys will only be able to act if you lose the capacity to make decisions yourself.

  • Property and Financial Affairs LPA

A Property and Financial Affairs LPA allows you to name Attorneys to deal with your property and your financial assets if you lose mental capacity. You can also choose for your Attorneys to be able to make decisions whilst you still have capacity, provided they have your permission. This can be helpful where someone suffers an illness or spends time outside of the UK.  

What happens if I don’t make a Lasting Power of Attorney?

If you lose mental capacity and you haven’t created a Lasting Power of Attorney, then nobody will have the legal authority to manage your affairs. Your spouse, partner or children may struggle to access bank accounts in your name or look after your property on your behalf.

If this occurs, it may be necessary for the person wishing to manage your affairs to apply to the Court of Protection to be appointed as a ‘Deputy’. This can be a lengthy process and can be very expensive.

How much does it cost to make a Lasting Power of Attorney?

Our charges for preparing a Lasting Power of Attorney and registering it with the Office of the Public Guardian are as follows:

One individual – one kind of LPA - £435 plus VAT and disbursements

One individual – both kinds of LPA - £485 plus VAT and disbursements

A couple – one kind of LPA - £635 plus VAT and disbursements

A couple – both kinds of LPA - £685 plus VAT and disbursements

We also offer a 10% discount if you also instruct us to prepare your Will at the same time.
